This page explains the terms by which a customer (“Customer”) of Momentum Recycling’s Residential Curbside Recycling Service (the “Service”) provided by Momentum Recycling, LLC (“Momentum”) uses the Service, and by which the Customer may use Momentum’s online and/or mobile services, Site, and software provided in connection with the Service.

 
DESCRIPTION OF SERVICE

Momentum will provide the Customer with a wheeled cart with lid (or other similar container) for collecting recyclables for recycling. On a regular collection frequency, Momentum will collect recyclables placed in the cart from the Customer’s location on the set collection day for where the Customer is located. The Customer can view information regarding their service in the My Account section on Momentum’s website located at https://utah.momentumrecycling.com (the “Site”).

 
CUSTOMER RESPONSIBILITIES

  • Place cart out at the curbside before 7:00 AM MST on collection day (if you do not wish to have your bin emptied, simply do not place it at the curb).
  • Ensure that the cart is not blocked, preventing collection; if cart is blocked, no collection will be made. If a follow-up visit is required due to a blocked container, an additional service fee may be assessed.
  • Be responsible for the safekeeping of the cart, which includes blocking or anchoring it to withstand wind, vandals and other conditions, as reasonably appropriate.
  • Fill cart with appropriate recyclables. Highly contaminated carts will not be emptied: Customer will be notified about the contamination and asked to remove contaminants before Momentum will empty the cart.
  • Ensure that no hazardous material, including batteries, electronics scrap, or hazardous chemicals or containers that have held hazardous materials, is put into any Momentum cart.
  • Update Momentum of any changes to your contact or billing information.

 
SERVICE FEES

Customer agrees to pay the Monthly Service Fee to Momentum indicated on the Site for their location. The Monthly Service Fee will be automatically charged each month by Momentum to the credit card provided by the Customer.

  • Activation Fee: each new Customer to the service will be charged a one-time Activation Fee indicated on the Site for their location, which will be applied to their first payment when signing up for the Service.
  • Damaged or Lost Cart Fee: if cart is damaged or lost, Customer will incur a Replacement Fee of $50.00 to replace the cart.
  • Delinquent Payments: Momentum will email notices to the Customer as the expiration date approaches for the credit card provided. In the event that the Customer’s credit card expires, Momentum will make all reasonable efforts to contact the Customer. If the Customer cannot be reached, and the credit card on file remains expired, Momentum will remove the cart from the Customer’s location and discontinue service.
  • Annual Subscriptions: By signing up for an annual subscription for glass or food waste recycling, you are committing to a full year (365 days) of service. If service is canceled with the contracted period, no refunds or partial refunds will be issued for the remaing terms of service.
  • Reactivation Fee: Momentum charges a $25.00 reactivation for any account that has been placed on hold due to “Customer Request”, “Billing Hold”, or “Failed Payment.

 

TEMPORARY ACCOUNT HOLDS

Customers are able to place their account or services with Momentum Recycling on hold. All holds have a required minimum hold time of one-month (30 days) and upon reactivation a $25.00 reactivation will occur on the provided credit card for the month the reactivation of service/s take place.

CANCELLATION

To cancel service, Customer must login to the My Account section on the Site. Upon cancellation, Momentum agrees to remove the cart from the Customer’s location within fourteen (14) days, in which event, Customer will have no further obligation to Momentum. If service terminates just after an auto-renewal of the Service or in the middle of the month, full payment for that month is required (no partial refunds will be provided). If the customer has signed up with Momentum Recycling’s glass or food waste services and has paid for the annual subscription. You are committing to a period of (1)one year worth of services. Upon canceling if within the 12 months of service, no partial or full refunds will be given for the remaining portion of the contracted period for services.

 
ELIGIBILITY & NON-DISCRIMINATION

By accepting these terms, Customer acknowledges that they have the authority to subscribe to the Service for the indicated location as the property owner, or by having the expressed consent of the property owner. Customer must be at least 18-years of age to subscribe to the Service. The Service is not available to any Customer previously removed from the Service by Momentum due to non-payment or multiple cart contamination incidences. Momentum does not discriminate on the basis of age, race, national origin, gender, sexual orientation or religion.

 
USER CONTENT & ONLINE CONDUCT

“User Content” refers to any such materials a Customer posts, submits, displays or otherwise makes available on the Site. Momentum encourages you to interact with the Site, subject to the following conditions:

  • You agree not to post User Content that (i) is harassing, discriminatory, libelous, obscene, false, inflammatory, pornographic, harmful, abusive, racially or ethnically offensive, defamatory, infringing, invasive, of personal privacy or publicity rights, humiliating, threatening, profane, or that infringes on the rights of any other Customer or third party or is otherwise objectionable; (ii) is your own or a third party’s advertising or promotional content; (iii) is unlawful or contains any information or content that is illegal; and (vi) contains information that you know to be inaccurate, not correct, or not current.

YOUR ACCOUNT

If you use the Site and create an account in the My Account section of the Site, you are responsible for maintaining the confidentiality of your account and corresponding password in order to restrict access to your account. You accept responsibility for all activities that occur under your account. Momentum reserves the right to refuse access to your account, with or without prior notice, and to remove or edit content submitted by you.

 
CONSENT TO RECEIVE NOTICES

You agree to receive communications from Momentum electronically and that we have the right to send you certain information in connection with the Site. If you do not consent to receive any notices electronically, you agree to stop using or accessing the Site. Momentum will communicate with you by email or by posting notices on the Site. You agree that all notices and other communications that Momentum provides to you electronically satisfy any legal requirements that such communications be in writing.

 
MODIFICATIONS & NOTICES

Momentum reserves the right to adjust the Activation Fee and Monthly Service Fee as necessary on an ongoing basis, but never more than one (1) time within a calendar year. Momentum will notify Customer of all such modifications at least ninety (90) days in advance. Any other modifications to these Terms of Service will be posted on the Site.

 
LIABILITY & INSURANCE

Momentum will maintain insurance coverage on Momentum employees, agents or subcontractors who render services described herein. Momentum is not responsible for any damage that may occur to pavement or other driving surfaces while providing service.
